pedestrian hit by car 300x286 Accidents Involving Pededstrians Hit By CarYesterday morning, September 20, as my wife and I pulled up to our favorite bagel restaurant, New York Bagel & Bialy, on Touhy Rd. in Skokie, we were in shock with what we saw:   a car had driven through the glass storefront of the bagel restaurant, and there was a person lying on the sidewalk in agony, with blood dripping from his forehead.  Police and emergency medical personnel eventually arrived to the scene to care for the injured person.

The accident involved a relatively common factual scenario with motor vehicle accidents:  a pedestrian hit by a car, resulting in significant injuries to the pedestrian.  To speak with a top-rated Chicago car accident lawyer with experience representing pedestrian, passenger and driver victims of car accidents, call Passen Law Group at (312) 527-4500 for a free consultation.

According to the most recent statistics from the National Highway Traffic Safety Administration’s (NHTSA) “Pedestrian Safety Program”, nearly 5,000 pedestrians were killed and 70,000 pedestrians injured  in traffic accidents in the United States in 2007.  To put that into perspective, a pedestrian is injured in a traffic crash every 8 minutes and killed in a traffic accident every 113 minutes.

Somewhat surprisingly,  most pedestrian fatalities occurred at non-intersection locations in normal weather locations.  Less surprisingly, most pedestrian deaths occurred at night, in urban areas, and during the weekend.  In nearly half of the pedestrian-vehicle accidents, alcohol was involved — either for the driver or the pedestrian.

The NHTSA mentions several safety reminders to prevent pedestrian-vehicle accidents from occurring:

  • Drivers must yield the right-of-way to pedestrians crossing the street in marked or unmarked crosswalks.  Still, pedestrians must be careful crossing at various dangerous intersections where the failure to yield right-of-way often occurs, such as where drivers turn onto another street and a pedestrian is in their path;
  • Pedestrians should cross the street at a designated crosswalk, and look both ways before crossing;
  • Pedestrians should maintain their visibility at night by carrying a flashlight or wearing retro-reflective clothing to highlight body movement;
  • Pedestrians should walk on the sidewalk where possible.  Alternatively, where walking on the street, pedestrians should walk facing traffic.

Drivers and pedestrians should stay mindful of these safety recommendations to prevent accidents, such as the pedestrian-car accident described above, from occurring.  In car accidents involving a pedestrian hit by a car, it is critical to contact a top car accident attorney.  To consult with a top injury lawyer with Passen Law Group, call us at (312) 527-4500.

New Law Bans Texting While Driving

Monday, August 10th, 2009

Previous posts have discussed the relationship between distracted drivers and catastrophic motor vehicle accidents.  In an attempt to minimize one cause of distracted drivers, namely sending text messages while driving, Illinois Governor Quinn signed legislation, which takes effect on January 1, 2010, banning texting while driving throughout the state.  The City of Chicago previously banned text-messaging while driving last year.

The bill does not prohibit talking on cell phones while driving, as long as the driver is not in Chicago.  The City of Chicago previously passed a bill banning talking on a cell phone while driving in the city, but that did not extend to other parts of Illinois.  However, Governor Quinn also signed a bill prohibiting drivers from talking on cell phones while driving through school-safety zones and construction zones.  This is obviously designed to prevent serious car accidents involving construction workers or school-safety workers.

The new law prohibits drivers from doing the following with their cell phone or PDA while driving:

  • sending text messages
  • reading text messages
  • surfing the internet
  • downloading ring tones
  • sending instant messagesre

Hopefully, this bill will achieve its designed purpose to reduce car and truck accidents caused by distracted drivers using their cell phones.  To speak with a top car and truck accident lawyer, call Passen Law Group at (312) 527-4500.

Common Neck And Back Injuries Sustained In Car Accidents

Tuesday, July 7th, 2009

Severe back pain as the result of a car accident may be a sign of a more severe injury such as a fractured or dislocated spine or a herniated or ruptured disc, which can be permanent and debilitating injuries.

One of the most common forms of back injury sustained in a car accident is whiplash. It occurs when the head is suddenly hyper extended, or violently thrust forward, and then backward, such as when a vehicle is rear-ended in a car crash. According to WebMd, speeds as low as 15 miles per hour can produce enough energy to cause whiplash. However, that number is high, especially where the vehicle causing the impact is a semi tractor-trailer, which can weigh several thousand pounds and cause a devastating impact at very low speed.

Symptoms of whiplash (as well as more serious back and neck injury) include:
• Neck pain and swelling
• Tenderness along the back of the neck
• Muscle spasms (in the side or back of your neck)
• Difficulty moving your neck around
• Headache
• Pain shooting from your neck into either shoulder or arm

It is important to seek medical care if you experience any of these symptoms after a car accident. An examination by a medical professional, along with X-Rays, MRIs and CT Scans, can help determine if there are other, more significant injuries, such as a fracture or ruptured disc. Such medical care can be expensive, so it is also important to consult with an experienced car accident attorney in Chicago about recovering damages.

A fractured spine or ruptured disc can be a lifelong problem, and require continued medical care. The spine is composed of bones, or vertebrae, separated by spongy discs that act as shock absorbers, and allow the spine to bend and move, giving the spine its flexibility. When these spongy discs become damaged, they can bulge or break open, and put pressure on nerves. This can cause a tingling sensation, pain and weakness in the parts of the body where the nerves travel.

A specific type of pain, called sciatica, can develop if a ruptured disc occurs in the lower back and press against the sciatica nerve. Sciatica is pain that travels through the buttocks and down a leg to the ankle or foot because of pressure on the sciatic nerve. Weaknesses in both legs, along with the loss of bladder or bowel control, are signs of a more severe type of nerve compression, called cauda equina syndrome. The nerves at the end of the spinal cord are being squeezed, must be treated immediately.

Though nonsurgical treatments, such as rest, physical therapy and pain medication can help treat a herniated or ruptured disc, in severe cases, such as cauda equina syndrome, surgery may be required, and the disc may need to be removed.

If you or a loved one has suffered a serious spinal injury as a result of a car accident, contact a top car crash lawyer in Chicago to review your case.
