Another Fatal Amtrak Train Accident

Thursday, October 6th, 2011

amtrak train crash 300x199 Another Fatal Amtrak Train AccidentAnother fatal Amtrak train crash has affected Chicago residents – but this time, the accident occurred in Michigan. The train in question was a passenger train operated by Amtrak, which had departed Chicago earlier in the evening of the crash, en route to Grand Rapids.

There was one fatality, a 19-year-old driver of the car struck by the moving train.

Although the cause of the accident is not yet confirmed, early reports state that the deceased auto driver turned in front of the train, attempting to “beat” the train despite the activated warning gates, which he maneuvered his car around. The local Sheriff has confirmed that the guards, as well as the lights and bells at the railroad crossing were working at the time of the accident.

There were seventy-two passengers aboard the train at the time of the accident.  Fortunately, none of the passengers was killed or seriously injured in the accident.

Our experienced train injury attorneys echo the sentiments of law enforcement calling for drivers to practice basic train safety with respect to obeying warning signs and crossing gates.  While many train accidents are caused by the negligence of railroad personnel or machinery, some accidents could be prevented by drivers and pedestrians following basic safety rules.

CTA Train Derailment – Minor Passenger Injuries

Monday, December 14th, 2009

train derailment 286x300 CTA Train Derailment Minor Passenger InjuriesOver the weekend, a Chicago Transit Authority (CTA) Green Line train derailed, sending 14 people to the hospital with injuries reported to be minor.  The derailment occurred Saturday afternoon near the curve of 59th and Calumet Avenue — the same area of another derailment in May of 2008.  To speak with a top CTA train and bus injury lawyer, call Passen Law Group at (312) 527-4500 for a Free Consultation.

There have been a number of CTA-related incidents the past few months, from a toddler in a stroller being dragged by a CTA train, to a CTA bus accident that sent 10 people to the hospital, to another CTA bus hitting a house, causing the house to be torn down for safety reasons.

Train and bus accidents can be serious, and sometimes fatal.  In Illinois, such accidents may fall under the Common Carrier Liability Act (740 ILCS 25/) and the Illinois Metropolitan Transit Authority Act (70 ILCS 3605/). The experienced Chicago injury lawyers of Passen Law can help you navigate the law, as well as  conduct a thorough factual investigation, so you can recover damages entitled under the law.

The CTA falls under both Acts, and is subject to changes in the Illinois Metropolitan Transit Authority Act that took effect June 1, 2009.  The most significant change is the repeal of Section 41, which eliminates the six-month notice requirement that had hampered many legitimate claims. The repeal applies to all “causes of action that accrue on or after” June 1, 2009.  However, the one-year statute of limitations still applies, which is why it is critical to contact a top public transportation accident lawyer as soon as possible.

CTA Bans Cell Phones and PDAs to Prevent Distracted Driver Accidents

Thursday, August 6th, 2009

cta bans cell phones 300x183 CTA Bans Cell Phones and PDAs to Prevent Distracted Driver AccidentsAn earlier post discussed the recent Virgina Tech study linking drivers distracted by cell phone usage to serious motor vehicle accidents.  Today, the Chicago Transit Authority (CTA) took note by issuing new rules designed to prevent CTA drivers from being distracted by using cell phones or other personal electronic devices.  The new rules are designed to prevent distracted CTA drivers from causing serious train or bus accidents in Chicago.

Specifically, the CTA rules, effective immediately, ban train conductors, operators, railroad maintenance workers and rail station customer assistance workers from using or carrying cell phones or personal digital assistants (PDAs), such as iPods, BlackBerry decices, Palm devices, other MP3 music players, wireless headsets or other devices.

CTA workers who violate the new rules face a “zero tolerance” policy, including suspensions and possible termination.  Indeed, CTA officials insist that one violation could lead to a CTA train operator or bus driver being fired immediately.

These new rules are clearly designed to prevent catastrophic train crashes or bus accidents caused by distracted CTA drivers.  CTA officials, including CTA President Richard Rodriguez, stated that the new rules are in response to recent serious transit accidents, which were seemingly caused by transit operators distracted by cell phone or PDA usage.   According to Mr. Rodriguez,  “the temptation to check text messages (or otherwise use a cell phone or PDA device while driving) is just too great.”

A separate, less stringent rule applies to CTA bus drivers.  Specifically, bus operators are prohibited from using cell phones or other electronic devices unless the driver is using a cell phone to contact the control center after the bus is completely stopped.  The CTA adopted separate rules for bus drivers because they are not given company cell phones or radios, with the exception of an emergency communication system available on every bus.  Conversely, CTA train operators are issued company cell phones and rail communication radios.
